About this page

I am Nicole Porter. I work as MamaFinds, creating user-generated content for family-focused consumer brands. I am based in Mesa, Arizona, and you can reach me at themamafinds@gmail.com.

This page explains how I ask you to use mamafinds.org, what is mine and what is not, and what this site is and is not. It is written to be read, not to be impressive.

There is nothing to sign up for here and no account to create, so I am not going to pretend you have signed a contract with me. Most of what follows is notice. I am telling you plainly where I stand so nobody has to guess. If you use this site, please use it the way this page describes. If any of it does not sit right with you, the simplest thing is to close the tab, and you are welcome to email me if you would rather talk about it.

What this site is

This is my portfolio and my marketing site. It exists so brands and agencies can see the kind of work I do and get in touch with me.

There is no shop to browse, no accounts, no logins, no comments and no newsletter. The contact form does not send anything to me on its own either. It builds an email in your own mail app with some text already filled in. None of that text is transmitted to or stored by this site, and I do not receive a word of it unless you decide to press send yourself.

There is one page where you can pay for a project. It is for work we have already discussed and agreed, not a storefront — I would much rather scope something properly by email first than have you buy a package that turns out to be the wrong fit.

If we work together, that work is covered by a separate written agreement for that specific project, agreed between us in advance. Scope, deliverables, usage rights, timing and payment all live in that agreement. If anything on the payment page ever conflicts with a signed project agreement between us, the signed agreement wins.

Please do not send me anything confidential in a first email. Wait until we have something in writing that covers it.

Payments

Payments are processed by Stripe. When you pay, you are taken to a page hosted by Stripe and you enter your card details there. Card numbers are never entered on this website and never pass through it, so I never see or hold them.

Prices on the payment page are in US dollars. Paying for a package covers the deliverables described next to it and nothing beyond that — additional videos, extended usage rights, rush timing or extra revisions are scoped and priced separately.

Paying is not the same as me starting work. I confirm by email that I have your payment and that I can take the project on, and that is the point work is booked. If I cannot take it on, I refund you in full. I will not sit on money for a project I am not going to do.

Refunds, cancellation and what happens if a project changes shape partway through are dealt with in the written agreement for that project, because those depend on how far along the work is. If something has gone wrong, email me at themamafinds@gmail.com before anything else. I would far rather sort it out directly than have you raise a dispute with your bank.

If a payment is made in error, or twice, tell me and I will refund it.

Using this site

You are welcome to look around, read everything, watch the videos, and share a link to any page here with anyone you like.

Please do not copy, download, republish, re-edit or reuse my photographs, videos or written content somewhere else without asking me first. Asking is usually all it takes. I say yes more often than people expect, and it takes one email.

Please also do not scrape the site, harvest the images and video in bulk, or feed my photographs and videos into a system that trains an AI model. I do not give permission for that. I know that stating my position is not the same as being able to stop it, but I would rather say clearly where I stand than leave it ambiguous.

And please do not use this site in a way that breaks the law, or that interferes with how it works for other people.

What is mine, and what is not

The photographs and videos I made, the words on these pages, and the way the site is put together are mine. Copyright applies automatically, and the notice on the site is there so nobody can honestly say they did not know.

Not everything you see here is mine, though, and I would rather be accurate about that than claim more than I have. Several of the photographs used around this site are licensed stock images. The portrait of me is my own photograph; a number of the others are not. The photographers who made those own them, and my licence does not let me pass rights in them on to anyone else. If you want to use an image like that, you would need to license it yourself from the source.

Some of what you see in my portfolio was made for clients. Depending on the agreement behind each project, the brand may own or share rights in that content. So when I show past work here, I am showing you what I made. I am not offering you rights in it.

Several pieces of content feature my own children. They are not props and they are not stock footage. Whatever the rights arrangement is behind a particular project, please do not lift images or clips of my kids out of this site and use them somewhere else. I am asking as their mother as much as anything else.

Brand names in my portfolio

My portfolio names the brands I have created content for. There is no way to show you what I actually did without saying who it was for.

Every brand name, trade name and logo shown on this site belongs to the company that owns it, not to me. They appear here for one reason, which is to identify real, completed work that I did.

Showing a brand’s name does not mean that brand endorses me, sponsors me, or is affiliated or partnered with me now. Each reference describes a specific past project and nothing more. I am not an authorised representative of any brand shown here, I do not speak for any of them, and I do not claim any continuing relationship beyond the work described.

I write about this work in the past tense and tie it to what was actually made, because that is what happened. If you ever see something on this site that reads like a current partnership when it is not, tell me and I will fix the wording.

If you work for a brand shown here and you would rather I did not display your name or your project, email me at themamafinds@gmail.com and tell me what you would like removed. I will take it down. I would much rather get an email than a letter.

About the opinions and the work shown here

A lot of what I make is my own experience with a product, at a particular time, in my own home with my own family. That is the whole point of the work, and it is also its limit.

Products change. Formulations get reworked, materials change, models get revised, and things get recalled. Something that was true about a product when I filmed it may not be true today.

Nothing on this site is medical, nutritional, safety or child-development advice, and it is not a substitute for a manufacturer’s instructions or for a professional you can actually talk to. Before you rely on anything you see here for your own family, check the manufacturer’s current guidance and current recall information, and make your own decision.

Much of the work in my portfolio was paid, and some of it involved product I was given. Where content of mine is sponsored or involves gifted product, I say so on the piece itself, in the post or the video where you actually see it. That disclosure belongs on the content, not buried on a page like this one, and I am not treating this paragraph as doing that job. I mention it here because it is honest context for reading a portfolio.

No warranties

This site and everything on it is provided as is and as available.

I do not promise that the information here is accurate, complete or current, or that the site will always be available or error-free. To the fullest extent the law allows, I disclaim implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

I work hard to keep this site truthful and up to date. That is a commitment about how I work, not a guarantee I am in a position to give.

Limits on my liability

To the fullest extent permitted by law, I am not liable for indirect, incidental, consequential, special or punitive damages, or for lost profits, arising out of your use of this site or anything you read here.

Nobody pays anything to visit this site. If I am ever found liable to you for something connected with your use of it, my total liability is capped at one hundred US dollars.

Some states do not allow certain exclusions or limits, so parts of this section may not apply to you.

This section is about the website. It does not touch anything in a signed project agreement between me and a client, which sets its own terms.

Links to other sites

Two places send you off this site: my Instagram profile, which is a plain link rather than an embedded feed, and Stripe, if you start a payment.

I do not control Instagram or Stripe, or any other site I might link to from here. I am not responsible for their content and I cannot vouch for what they do. Once you click through, you are on their site, and their terms and their privacy practices apply alongside or instead of mine.

If you think I have used something of yours

If you believe something on this site is yours and I should not be using it, please email me at themamafinds@gmail.com. Tell me what it is, where on the site you found it, and why you believe it is yours.

I will look at it properly, and if you are right, I will take it down. There is no form and no process to navigate. Just email me.

Changes to these terms

I may update this page from time to time, usually because something about the site or about how I work has changed. Any update takes effect when I post it here.

There are no accounts and no mailing list on this site, so there is nobody for me to notify. The date near the top tells you which version you are reading.

If part of this page turns out to be unenforceable, the rest of it still stands.

Governing law and where disputes would be heard

These terms, and any dispute connected with this site, are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules.

Any dispute would be brought in the state or federal courts located in Maricopa County, Arizona, which is where I live and work.

Being straightforward about it, this is a statement of my position, published on a site where there is nothing to sign. Depending on where you are and what a dispute is about, a court may not be bound by it, and the consumer protection laws of your own state may still apply. I am telling you where I am and where I would expect a dispute to be heard. I am not trying to take away rights anyone already has.

One last thing

I wrote this page myself, in my own words, to describe how this site actually works. I am not a lawyer, and it is a plain statement of my position rather than a formal legal document.
